Legal Separation

Legal separation is for couples who are not yet ready for divorce or couples who for religious or other reasons do not wish to become divorced. In a legal separation, a judge is able to make orders regarding property and debt division, spousal maintenance, child custody, parenting time, and child support that would be made in a divorce proceeding, except that the marriage itself is not dissolved.

Afterwards, each party will be responsible for their own finances and neither party can remarry. However, if either party later on decide they do not want to become divorced, it is relatively simply to convert the decree of legal separation into a decree of dissolution, since all matters have already been decided.

At De Blank & Toussaint we understand that divorce is not an option for all couples. In those circumstances our experienced staff is able to help obtain a legal separation. If you are interested in more information about or are seeking a legal separation please contact us for a consultation.
